Terms of Service
These Terms govern your use of the BallBall.tech website and services ("the Service"), operated by BallBall Inc. ("BallBall," "we," "us"). By creating an account or registering for a tournament, you agree to these Terms.
1. The Service
BallBall provides software and AI tools for padel clubs and players, including tournament administration, match analysis, video delivery, and player statistics. Specific features and deliverables are described on ballball.tech and in the agreement between BallBall and the host club.
2. Eligibility and registration
You must be at least 16 years old to register, or 18 in jurisdictions where this is required. Participants under 16 must be registered by a parent or legal guardian. You agree to provide accurate registration information and to keep it up to date.
3. Tournament participation
When you register for a tournament hosted by a club using BallBall:
- the host club is responsible for the operation of the tournament, including bracket, schedule, prizes, and on-site logistics;
- BallBall is responsible for the technical service: admin tools, video processing, statistics, and content delivery;
- you agree to follow the rules set by the host club and the reasonable instructions of tournament staff.
4. Your content and rights to your video
You retain ownership of your name, image, and likeness. By registering, you grant BallBall a limited license to:
- record, process, and store match video featuring you;
- run AI analysis on match video to generate your personal stats and achievements;
- display your match video and stats on your personal tournament page, accessible to you and to people you share the link with.
You may grant additional permissions at registration — for example, authorising the host club to use highlights of you in social media. You can revoke any such optional permission at any time by contacting us.
5. AI-generated stats and limitations
Match stats and achievements are produced automatically from video analysis. While we work to keep accuracy high, we do not guarantee that every metric is correct. Stats are provided for entertainment and information; they do not constitute an official rating, qualification, or certification.
6. Acceptable use
You agree not to:
- use the Service to harass, defame, or harm other players;
- attempt to extract or scrape match video or stats belonging to other players;
- attempt to bypass authentication or access data not intended for you;
- use the Service in any way that breaches applicable laws.
7. Intellectual property
The Service, including the BallBall website, software, AI models, and brand assets, is owned by BallBall and protected by intellectual property law. These Terms do not grant you any rights to BallBall's IP beyond use of the Service as intended.
8. Disclaimers
The Service is provided "as is" and "as available." We make no warranties about uptime, accuracy of stats, or availability of features. Tournaments depend on physical infrastructure (cameras, network) that may fail despite our reasonable efforts.
9. Limitation of liability
To the maximum extent permitted by law, BallBall is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you in connection with the Service is limited to the greater of (i) the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim, or (ii) one hundred US dollars (US$100).
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In those jurisdictions, the limitations above apply only to the extent permitted by applicable law.
10. Termination
You may delete your account at any time. We may suspend or terminate your account if you breach these Terms or if continuing the Service would be unreasonable. On termination, your data is handled as described in the Privacy Policy.
11. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
If you are a consumer located in the European Union, the European Economic Area, the United Kingdom, or Switzerland, the mandatory consumer protection laws of your country of residence continue to apply notwithstanding the choice of Delaware law, and you may also bring proceedings before the courts of your country of residence.
12. Changes
We may update these Terms. Material changes will be communicated by email and posted on the website with a new "Last updated" date.
